Was Yacqub Khayre’s parole in breach of the Callinan Review?

If the Callinan Review into parole had been fully implemented by Daniel Andrews then Yacqub Khayre would not have been released on parole.

Measure 13 of the Callinan Review (page 95), clearly states:

“Similarly, no person, whether a PDP or not, should be granted parole who has not behaved satisfactorily for at least the second half of that person’s time in prison. Failure to meet these requirements should be clear disqualifications for parole.”

According to reports, in February 2015, Yacqub Khayre, committed arson at Barwon Prison and was sentenced to two months jail.

This arson offence occurred during Yacqub Khayre’s second half of his prison term and therefore by the terms of the Callinan Review he should have been disqualified for receiving parole in December 2016.

Yacqub Khayre appears to have been paroled in breach of Callinan’s reforms which Daniel Andrews claimed had been fully implemented in Question Time only last Tuesday (Hansard, 6 June 2017, page 8).

The reported timeline of events are:

• 22 April 2012: Date of offence (home invasion)
• 22 April 2012: Arrested and remanded same day
• 12 October 2012: sentenced (sentence took into account remand since 22 April)
o Sentenced to five years and six months imprisonment, with non-parole period of three years.
o Full sentence would have meant imprisonment until October 2017.
• 7 Feb 2014: Yacqub Khayre set fire to Loddon Prison
• August 2014: the mid-point of Khayre’s prison sentence
• 21 Feb 2015: Yacqub Khayre committed arson at Barwon Prison (in the second half of his term)

• December 2016: Yacqub Khayre paroled
o Total time served was four years and seven months in jail
o The mid-point for his jail time was August 2014
o His arson offence in February 2015 was in the second half of his time in prison
